Carestream Health has filed a lawsuit alleging that Caliper Life Sciences of Hopkinton, MA, is infringing on its multimodal in vivo imaging patent.
The suit, filed in the U.S. District Court for the Western District of Wisconsin, Madison Division, alleges that Caliper's IVIS Lumina XR system infringes on Carestream's U.S. Patent No. 7,734,325, titled Apparatus and Method for Multi-Modal Imaging, according to Carestream of Rochester, NY.
Filed in September 2004 and granted on June 8, 2010, the patent relates to an imaging system in which one or more immobilized small animals can be imaged in several imaging modes without moving the animal, Carestream said.
Carestream asking the court to preliminarily enjoin Caliper from continuing to market and sell IVIS Lumina XR systems during the lawsuit and to permanently enjoin sales of the product, the company said.
