Breast brachytherapy developer SenoRx of Irvine, CA, is claiming victory in patent litigation with women's imaging vendor Hologic of Bedford, MA, over breast brachytherapy technology.
SenoRx said that a jury in the U.S. District Court for the Northern District of California delivered a verdict in favor of SenoRx in the dispute. Hologic sued SenoRx in January 2008, charging the company with violating U.S. Patent Nos. 5,913,813, 6,413,204, and 6,482,142, and seeking to prevent SenoRx from selling its Contura balloon-based brachytherapy device.
The jury found that SenoRx was not liable for infringement of the '204 patent and that both that patent and the '142 patent were invalid, according to SenoRx.
