Software developer Tandem Radiology has denied infringing on patents held by teleradiology services provider Virtual Radiologic (vRad) and NightHawk Radiology Services.
In August, vRad filed litigation charging that after five former vRad employees left the company to join Tandem, the firm launched its own teleradiology software that bears "substantial similarities" to vRad's software and that allegedly infringes on vRad patents. vRad is also suing Tandem and customers Imaging Advantage and Direct Radiology.
However, on October 21, Tandem and the individuals named in the suit filed a response with an Arizona federal court, countering that its teleradiology technology platform was developed from scratch starting in July 2011 and the cost of original research and development of the Tandem system was borne by Tandem.
The response goes on to that state that the "defendants have not infringed and are not infringing, either directly or indirectly, any claim of the '634, '593, '503, '481, and '778 patents, either literally or under the doctrine of equivalents."
Tandem also stated that it plans to "vigorously defend itself in court" and continue to provide services to its customers.
