Teleradiology services provider Virtual Radiologic (vRad) and its NightHawk Radiology Services subsidiary have settled a lawsuit asserting patent infringement by Tandem Radiology.
The settlement includes a consent judgment of patent infringement by Tandem and an injunction prohibiting use of the Tandem platform. The companies have agreed to a wind-down period for use of the platform to ensure there are no interruptions in patient care.
Tandem maintains that the patent infringement was innocent and nonwillful, a point the other parties do not dispute. Tandem also denies the other allegations in the suit, which included trade secret misappropriation, copyright infringement, and breach of contract.
vRad said it is pleased with the resolution, which affirms its patent rights and protects its investments going forward.
