Archiving services provider InSite One said that it has filed a claim for patent infringement against National Digital Medical Archive (NDMA) of Berwyn, PA, and i3Archive, a brand NDMA used until August this year.
Prior to filing the patent infringement claim, InSite One said it contacted NDMA to discuss the company's services and InSite One's patent. NDMA filed a lawsuit on September 25 this year in the U.S. District Court for the Eastern District of Pennsylvania for declaratory judgment of noninfringement and invalidity of the InSite One patent, according to NDMA.
In its response, filed last Friday, InSite One alleges that NDMA and i3 infringe its U.S. Patent (No. 6,574,742), which relates to the offsite storage and management of digital images.
InSite One said it is seeking an injunction to halt both NDMA and i3 from offering its services to present and future customers and for payment of damages.
NDMA said it is its intention to pursue its case of invalidity and noninfringement aggressively.
