National Digital Medical Archive (NDMA), its parent company i3Archive, and InSite One have agreed to dismiss all claims and counterclaims in the companies' lawsuits. Details of the settlement were not released.
The dispute dates back to September 2006, when Berwyn, PA-based NDMA filed a lawsuit in the U.S. District Court for the Eastern District of Pennsylvania for a declaratory judgment of noninfringement and invalidity of an InSite One patent.
In October 2006, InSiteOne of Wallingford, CT, filed a counterclaim for patent infringement against NDMA and i3Archive. Prior to the filing, InSite One said it contacted NDMA to discuss the company's services and InSite One's patent.
At the time, InSite One alleged that NDMA and i3Archive infringed its U.S. Patent No. 6,574,742, which relates to the offsite storage and management of digital images. The company sought an injunction to halt NDMA and i3Archive from offering its services to present and future customers, and payment for damages.
