Trial date set for CT radiation overdose lawsuit

A trial date has been set in a lawsuit filed by the parents of a child who received an excessive radiation dose while undergoing a CT exam at a community hospital in California.

Arguments in the lawsuit against Mad River Community Hospital in Arcata will begin on January 11, 2010, in the Superior Court of California. The lawsuit charges the hospital with negligence after a 2-year-old boy allegedly received a radiation dose equivalent to 151 CT scans in a one-hour period in January 2008.

In March 2009, the California Department of Public Health (CDPH) in Sacramento issued a $25,000 fine against the hospital after a CDPH investigator determined that the hospital failed to follow its own written policies and procedures regarding radiation safety and use of the lowest possible radiation dose. The hospital plans to appeal the fine.
