Attorneys took the first steps on Tuesday toward the filing of a lawsuit against a West Virginia hospital on behalf of patients who received excessive CT radiation doses at the facility.
Two law firms -- Hill, Peterson, Carper, Bee, & Deitzler and Powell & Majestro -- filed a notice of claim against both Cabell Huntington Hospital and service provider Radiology Inc. on Tuesday, a Hill Peterson attorney told AuntMinnie.com. The filing is required 30 days before a lawsuit can be filed in Mason County Court.
Between October 2009 and November 2010, Cabell Huntington patients undergoing CT angiography of the head and neck received higher-than-recommended doses, according to a written statement from the hospital earlier this month detailed in a March 9 article on AuntMinnie.com.
Although patients may have received higher doses than recommended, they were "still within the range of normal for complex imaging procedures," the hospital said.
This week's notice was filed on behalf of patients Tammy Green, Michael Lucas, and Kathryn Hamlin, said Aaron Harrah, the Hill Peterson attorney who filed the notice. The firms intend to file a class-action suit on behalf of these and other patients contacted, Harrah told AuntMinnie.com.
