Interventional technology provider AngioDynamics has filed a patent complaint against interventional device developer Diomed in the Delaware U.S. District Court.
Queensbury, NY-based AngioDynamics is seeking a declaratory judgment that Diomed's recently issued 6,981,971 patent, entitled Medical Laser Device, is invalid, unenforceable, and not infringed by the manufacture or sale of AngioDynamics' VenaCure endovenous laser treatment system. The patent relates to a medical device that includes graduated markings along a sheath used in endovenous laser treatments, according to AngioDynamics.
In January 2004, Diomed filed suit against AngioDynamics alleging patent infringement related to the VenaCure device. This suit involves a single U.S. patent, 6,398,777, covering a specific method of varicose vein treatment and is ongoing, AngioDynamics said.
