Intensity modulated radiation therapy (IMRT) provider Nomos has appealed an adverse court ruling in its patent infringement case against Zmed, an Ashland, MA-based medical technology firm.
Although the court found that the alpha version of Zmed’s SonArray system infringed the Nomos patent, the court also concluded that the current version does not because it does not use a bracket to attach the ultrasound probe to the treatment table, according to Sewickley, PA-based Nomos.
"We respectfully disagree with the court’s decision that the current Zmed product does not violate our patent and we intend to address this ruling vigorously in the court of appeals for the (U.S.) Federal Circuit," said John Manzetti, Nomos president and CEO.
