The U.S. Court of Appeals for the Federal Circuit has affirmed a lower court ruling on the invalidity of two Loma Linda University Medical Center patents.
The decision is a victory for Ion Beam Applications (IBA) of Louvain-la-Neuve, Belgium. The nuclear medicine products firm said the court decision will allow it to market proton-beam therapy systems in the U.S. that include gantry patient treatment rooms with or without fixed-beam patient treatment rooms.
IBA also will continue to market its control system that verifies the authenticity of proton-beam request signals before the beam is transported for treatment.
