The U.S. Court of Appeals for the Federal Circuit has reversed a judgment against women's healthcare vendor Hologic in a patent infringement suit with breast brachytherapy developer SenoRx.
Hologic and its Cytyc subsidiary filed the patent infringement lawsuit against SenoRx in 2008, alleging infringement of a breast brachytherapy patent held by Hologic.
In December 2009, the U.S. District Court for the Northern District of California granted SenoRx a summary judgment following a jury verdict.
On February 24, citing an incorrect claim construction, the appeals court reversed the district court's granting of summary judgment of invalidity and reversed the district court's judgment of invalidity.
The matter has been remanded to the district court for further proceedings consistent with the appeals court's judgment.
