PACS developer New Mexico Software, doing business as Net Medical Xpress, has won a favorable judgment in federal court from a lawsuit initiated by Premier Medical Enterprise Solutions of St. Petersburg, FL.
The judgment dismissed all claims against New Mexico Software and its chief executive officer, Richard Govatski, made in a lawsuit filed by filed by Premier Medical in February 2009. The lawsuit claimed that the company had breached its fiduciary duty and contract, and it sought a minimum of $75,000 in damages plus all related legal fees.
In addition, U.S. District Court Judge Bruce Black awarded New Mexico Software $636,605.88 in damages sought in counterclaims.
The two companies began doing business together in December 2005, with New Mexico Software providing its XR-EXpress PACS to Premier. Premier Medical filed for bankruptcy protection on November 11, 2010, in a Florida court.
