A month after filing a patent infringement suit against Hologic in the U.S., Fischer Imaging is taking its case to Europe. Denver-based Fischer has now filed suit against Hologic of Bedford, MA, and its distributors in France and Germany for infringement of European patent 0 625 024, which relates to features used in prone stereotactic breast biopsy systems, Fischer said.
The suits ask the courts to determine damages for the sale of what Fischer calls infringing products by Hologic/Lorad and distributors of Lorad. The vendor has also requested an injunction preventing further sale of the products in France and Germany, and for its legal expenses to be paid.
Continuing its long-standing legal battle with Hologic's Lorad unit, Fischer filed suit against Hologic in November, alleging that its Stereoguide (also known as Multicare) prone breast biopsy system infringes Fischer's U.S. Patent No. 5,735,264.
In a suit filed in the U.S. District Court in Boston, Fischer requested an award of damages of lost profits with interest, and that the damages be trebled due to what it called willful and deliberate infringement. Fischer also asked that Hologic be enjoined from further sale, manufacture, or use of these products. Fischer is seeking to be awarded its attorney's fees and is requesting a jury trial.
