Digital radiography developer Swissray International has received a favorable ruling in its four-year intellectual property battle with French firm DMS-Apelem of Nimes, France.
The Board of Appeal of the European Patent Office declared on December 2 that Swissray's patent EP862748 is valid and that an appeal by DMS-Apelem is without merit, according to the Elizabeth, NJ-based vendor. The French firm had sought a revocation of the Swissray patent.
With the ruling, Swissray said it would now continue its infringement litigation in France against DMS-Apelem.
