Jubilant DraxImage said that it has received favorable rulings from the U.S. Patent and Trademark Office (USPTO) relating to its ongoing dispute with Bracco Diagnostics.
The USPTO has agreed with the company's arguments that the two rubidium-infusion system patents owned by Bracco are invalid, Jubilant said. In a lawsuit filed in 2018, Bracco alleged that Jubilant's Ruby-Fill generator and Ruby rubidium elution system were infringing on its two patents. Jubilant subsequently challenged the validity of these patents.
As a result of the new favorable rulings, Jubilant expects the USPTO will cancel all challenged claims of the two Bracco patents.
In December 2019, the U.S. International Trade Commission also upheld an administrative law judge's ruling that Jubilant did not violate unfair competition law by selling its rubidium elution systems in the U.S.
