Alliance wins patent interference ruling against Nycomed

Alliance Pharmaceutical has won a favorable final judgment from the U.S. Patent and Trademark Office's Board of Patent Appeals and Interferences. The case concerned claims in an ultrasound contrast patent owned by Nycomed Imaging. The final judgment determined that claims made in the Nycomed patent (formerly owned by Sonus Pharmaceuticals) with respect to microbubbles that contain perfluorohexane (PFH) gas are invalid and are therefore unpatentable, according to San Diego-based Alliance.
