The American College of Radiology (ACR) has joined with two other associations to ask the U.S. Centers for Medicare and Medicaid Services (CMS) to resume all disputed payment determinations called for under the No Surprises Act.
The CMS had paused independent dispute resolution (IDR) payment determinations on February 6 following a decision by the U.S. District Court for the Eastern District of Texas in a lawsuit filed by the Texas Medical Association. The ACR, the American College of Emergency Physicians (ACEP), and the American Society of Anesthesiologists (ASA) said, though, that the government's pause has exacerbated the existing backlog of IDR determinations and is causing harm to healthcare providers who provide those services.
Although CMS has since provided some relief when it instructed certified IDR entities to resume making IDR determinations for payment disputes for services furnished before October 25, the organizations are now calling on the CMS to also resume swift determinations for disputes involving items or services performed on or after that date.
