A Kansas jury has found no antitrust violations in a case brought by a radiologist against his former radiology group, but it has awarded the radiologist more than $700,000 in damages, according to a report from Kansas City, MO, radio station KCUR.
Dr. Mark Idstrom brought suit against Alliance Radiology of Kansas City in 2012 under that state's antitrust statute, the Kansas Restraint of Trade Act (KRTA), claiming that the company and members of its board conspired to violate antitrust laws. He sought $2.5 million for violations of KRTA, breach of fiduciary duty, and civil conspiracy, KCUR said.
Jurors ignored Idstrom's KRTA claim, instead awarding him $1 against each of the individual defendants on the breach-of-fiduciary-duty claim and $719,000 on the civil-conspiracy claim, according to the article.
An attorney for Alliance Radiology said the company plans to ask presiding Judge Robert Wonnell of Johnson County District Court to set aside the damage award, KCUR reported.
