David Kwiatkowski, the radiologic technologist who is serving 39 years in prison after infecting patients with hepatitis C as part of a drug diversion scheme, is asking a federal court in New Hampshire to throw out his sentence.
In a motion filed from a Florida prison, Kwiatkowski claims that he was not adequately represented by his lawyer, who allowed him to plead guilty while he was "under extreme emotional distress," according to an article in the Baltimore Sun. He also believes his sentence was incorrectly calculated.
Kwiatkowski was a traveling technologist who in 2013 pleaded guilty to multiple counts of stealing fentanyl intended to sedate patients before interventional radiology procedures. He continued to do so after receiving a diagnosis of hepatitis C in 2010; as a result, dozens of patients in multiple states were infected with the virus, and at least one person died.
Kwiatkowski is currently scheduled to be released in 2046, according to the article.
