Nordion has lost its arbitration case against Atomic Energy of Canada (AECL) seeking damages from AECL's canceled construction of the MAPLE nuclear reactor facilities.
A tribunal ruled 2 to 1 that Nordion's claim against AECL was not covered under the terms of a 2006 agreement between Nordion and AECL. The arbitrators also dismissed AECL's counterclaim against Nordion, which claimed damages for breach of contract in the amount of $250 million and other relief.
The MAPLE facilities were intended to replace AECL's National Research Universal (NRU) reactor. The 2006 agreement stipulated that AECL would bring the MAPLE reactors into service by October 2008 to provide Nordion with a 40-year supply of isotopes.
